ABEOKUTA – The factional Secretary of Labour Party in Ogun State, Hon. Oginni Olaposi Sunday and two others have approached a Federal High Court sitting in Abeokuta to prevent a member of Peoples Democratic Party (PDP) in Ogun State representing Remo Federal constituency at the House of Representatives, Hon. Ladi Adebutu from hijacking the structure of the party in the state.
The plaintiff, Hon. Oginni Olaposi Sunday and two others had in a suit number: FHC/AB/CS/123/18 charged Hon. Ladi for sponsoring the 3rd – 5th defendants (Arabambi Abayomi, Sina Aroyewun and Bode Simeon) to hijack the structure of the party in Ogun State from them.
The suit further accused Hon. Ladi of inducing executive of the party with money and sponsoring of the parallel congress that brought the 3rd, 4th and 5th defendants into office.
But in a 18 paragraphs counter affidavit filed by counsel to the 7th defendant (Ladi Adebutu) on 29th October, 2018, Barrister S. O Muftau told the court to discountenance the suit and dismiss the case brought before it against his client.
He said, the 7th defendant cannot be a member of 2nd defendant (Labour Party) being a member of Peoples Democratic Party (PDP).
Barr. Muftau said the case brought against his client was mere speculation which cannot be substantiated by law.
“My Lord, I rely on all arguments and authorities cited in the 18 paragraphs counter affidavit filed on 29th of October, 2018.
“My Lordship, the 7th defendant is a member and gubernatorial candidate of PDP in Ogun State and has no right to be member of the 2nd defendant (Labour Party).
“I therefore urged this honourable court to discountenance the claim as speculative around. We pray that this honourable court dismiss the case for lacking substance.”
In his reaction, the plaintiff lawyer said the court cannot dismiss the case as the 7th defendant (Ladi Adebutu) was the one who provided abode for the 3rd, 4th and 5th defendants to held its congress.
The plaintiff therefore pray the court to show the 7th defendant total exit from the party and barnish him from hijacking the party for his political ambition.
The court has adjourned further hearing of the case to November 12th, 2018.
